2025 Insurance Regulatory Changes: What African Corporates Need to Know

Insurance regulation across Africa is tightening, and 2025 is a particularly active year. For corporates operating in multiple jurisdictions, the compliance burden is real, but so is the risk of discovering at claim time that a policy bought abroad is unenforceable at home.

The three trends that matter

First, local retention and admitted insurance rules are being enforced more strictly. Several markets now require that risks located in-country be placed with locally licensed insurers up to defined thresholds, with cessions abroad only permitted once local capacity is exhausted. Programs designed years ago on a non-admitted basis need review.

Second, mandatory covers are expanding. Beyond the familiar motor third-party and workmen's compensation requirements, several jurisdictions are introducing compulsory professional indemnity for regulated professions, mandatory decennial liability on construction projects, and required environmental cover for extractive operations.

Third, data protection law now touches insurance directly. Employee benefits programs move sensitive personal data between employers, brokers, insurers, and administrators. Regulators increasingly expect documented lawful bases and data processing agreements at every link in that chain.

A practical checklist

Map every policy in your program to the country where the risk is located, and confirm the placement basis is permitted there. Ask your broker to certify local compliance in writing for each jurisdiction. Review construction contracts signed this year for new mandatory cover clauses. And confirm your benefits administrator's data processing terms have kept pace with local law.
